Cargo Termination of Storage
1. İşbu Polie’de yer alan aksi yöndeki hükümlere veya atıfta bulunulan klozlara bakılmak-
sızın, bu Poliçe’nin antrepoya alınmış olan veya depolanan yüklerle ilgili zarar-ziyan veya
kayıpları teminat altında bulundurduğu süre zarfında, söz konusu teminatın, ilgili yüklerin
anterepoda bulundurulduğu ve/veya depolandığı sırada transit halde olması şartına bağlı
bulunduğu ve, hangisi daha önce gerçekleşir ise:
1.1. Poliçe’de yer alan transit klozları uyarınca,
veya
1.2 Alıcı’nın nihai antreposuna veya deposuna ya da bu Poliçe’de belirtilen nihai varış
yerindeki diğer bir antrepoya teslim edildiğinde,
1.3 Poliçe’de belirtilen nihai varış yerinde veya daha öncesinde, tahsilat veya dağıtım amaçlı normal transit sevkiyatlar haricinde Sigortalı’nın depolama amacıyla kullandığı diğer bir antrepoya veya depoya teslim edildiğinde.
veya
1.4. deniz yoluyla yapılan transit sevkiyatlarla ilgili olarak, nihai varış limanında işbu
Poliçe ile sigortalanan yüklerin denizaşırı gemiden mavnalara boşaltma işleminin
tamamlandığı tarihten itibaren geçen 60 günlük sürenin sona erdiği tarihte,
1.5. hava yoluyla yapılan transit sevkiyatlarda, işbu uçaktan boşaltıldığı tarihten itibaren
geçen 30 günlük sürenin sona erdiği tarihte
her halükarda FESHOLACAĞI konusunda mutabakata varılmıştır.
2. İşbu Poliçe veya bu Poliçe’de atıfta bulunulan Klozlarda, depolama sonrasında yapılacak yurtiçi veya diğer müteakip transit sevkiyatların teminat altına alındığına ilişkin özel bir hükmün bulunduğu hallerde, sigorta teminatı tekrar başlatılacak ve Terörizm İstisnası Klozu uyarınca feshedilmek üzere, söz konusu normal transit sevkiyat süresi zarfında devam ettirilecektir.
CARGO TERMINATION OF STORAGE IN TRANSIT CLAUSE
(for warehousing and or storage risks insured in the ordinary cause of transit )
This clause shall be paramount and shall override anything containes in this insurance inconsstent therewith.
1. Nortwithstanding any provision to the contrary contained in this Policy or the Clauses
referred to therein, it is agreed that in so far as this Policy covers loss of or damage to the
subject-matter insured whilst being warehoused and/or storage being in the ordinary
course of transit and, in any event, SHALL TERMINATE EITHER:
1.1. As per the transit clauses contained within the Policy,
or
1.2. on delivery to Consignee’s or other final warehouse
1.3. on delivery to any warehouse or place of storage, whether prior to or at the destination
named herein, which the Assured elect to use either for storage other than in the
ordinary course of transit or for allocation or distribution,
or
1.4. in the respect of marine transits, on the expiry of 60 days after completion of
discharge overside of the goods hereby insured from the oversea vessel at the final
port of discharge,
1.5. in respect of air transits, on the expiry of 30 days after unloading the subject-matter
insured from the aircraft at the final place of discharge.
whichever shall first occur.
2. If this Policy or tha Clauses referred to therein specifically provide cover for inland or other futher transits following on from storage, covert will reattach,and continues during the ordinary course of that transit terminating again in accordance wth the Terrorism Exclusion Clause.
